Prices

Prices are per the currency stated on the Purchase Order and are exclusive of VAT. We buy in bond unless specifically stated otherwise.

Description/Quality

We will undertake to inspect all goods immediately but no later then 7 days after delivery and will notify the seller or the carrier forthwith of any shortage, damage or other deficiency. We reserve the right to immediate and full refund of monies paid by us, or demand replacements for any stock supplied to us which does not satisfy the following minimum condition requirements: clean unmarked labels, sound capsules, fill levels of base neck or higher, free of US or Far Eastern export strip labels and packed in the original case without defacement.

Title and Risk

When we agree to have the goods collected, we buy FCA seller, in accordance with the international trading definitions as described in the Incoterms 2000. When seller arranges for delivery, the risk in all goods that we buy shall pass to us as soon as they have been delivered into and accepted by our warehouse, in accordance with Incoterms DDU or DDP.

Force Majeure

We shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.

Acceptance

The placing and accepting of oral orders shall form a contract between buyer and seller, conditional upon buyer’s written confirmation of the order by means of the delivery of a purchase order. Unless specifically disputed by the seller, these terms apply.

Law

All our contracts are made under English Law and are subject to the exclusive jurisdiction of the English Courts.
